Filing for Divorce

Please refer to Rule 63 (Divorce and Family Law) of the Supreme Court Rules and Forms as well as Rule 63A (Family Law Proceeding and Financial Disclosure). The Supreme Court Rules and Forms (in Microsoft Word format) can be found at www.yukoncourts.ca under Supreme Court, Yukon Rules and Forms. You can also review the Divorce Act (Canada) at www.canlii.org.

To start a divorce, you must:

  • Complete the Statement of Claim (Family Law) - Form 91 and make three (3) copies so you can present four (4) sets for filing with the Supreme Court;
  • Bring your original Certificate of Marriage which will stay on the court file;
  • Obtain a money order in the amount of $10 payable to "The Receiver General for Canada" so that we can register your divorce at the Central Registry of Divorces in Ottawa where they check that no other divorce file has been started under those names; and
  • Pay the filing fee of $140 (cash, check, debit or credit card).

If you are claiming child support, spousal support or parental support, or division of assets, please read and refer to Rule 63A regarding financial disclosure. The following forms may be applicable to your case:

  • Financial Statement - Form 94
  • Notice to File a Financial Statement - Form 95
  • Agreement as to Annual Income and Amount of Child Support - Form 96
